By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our services.

2. Services Description

PixlData provides the following services:

• Data annotation and labeling services
• Image, video, and audio annotation
• Text classification and NLP services
• Medical imaging annotation
• Computer vision dataset preparation
• Quality assurance and validation
• Custom AI training data solutions

Specific service details, deliverables, timelines, and pricing will be outlined in separate Service Agreements or Statements of Work.

3. Account Registration and Security

To access our services, you must create an account and provide accurate, complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Providing accurate and up-to-date account information

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Data Handling and Ownership

4.1 Client Data

You retain all rights, title, and interest in your data submitted for annotation ("Client Data"). We will:

• Process Client Data solely for providing agreed services
• Implement appropriate security measures to protect your data
• Not use Client Data for our own purposes without explicit consent
• Return or delete Client Data upon service completion or termination

4.2 Annotated Data

Upon full payment, you will own the annotated datasets we create. However, we retain the right to:

• Use aggregated, anonymized insights for service improvement
• Retain annotation methodologies and processes
• Use general knowledge gained for future projects

5. Client Responsibilities

You agree to:

• Provide data in agreed formats and specifications
• Ensure you have legal rights to submit data for annotation
• Comply with all applicable laws and regulations
• Not submit illegal, harmful, or infringing content
• Provide clear annotation guidelines and requirements
• Pay all fees according to agreed payment terms
• Respond promptly to requests for clarification

6. Prohibited Uses

You may not use our services for:

• Illegal activities or content that violates laws
• Harassment, discrimination, or harmful content
• Infringing intellectual property rights
• Creating deepfakes or misleading content
• Developing surveillance or tracking systems without consent
• Military or weapons applications
• Any purpose that could harm individuals or society

7. Payment Terms

Payment terms will be specified in your Service Agreement. Generally:

• Invoices are due within 30 days of receipt
• Late payments may incur interest charges
• We may suspend services for overdue accounts
• All fees are non-refundable unless otherwise agreed
• You are responsible for applicable taxes

8. Quality Assurance and Delivery

We strive to deliver high-quality annotations meeting agreed specifications:

• Target accuracy rates will be specified in Service Agreements
• Quality control processes include multiple review stages
• Delivery timelines are estimates and may vary based on complexity
• We will work with you to address quality concerns

9. Confidentiality

We maintain strict confidentiality regarding your data and business information:

• All team members sign confidentiality agreements
• Access to client data is limited to authorized personnel
• We implement technical and organizational security measures
• Confidentiality obligations survive termination of services

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our total liability shall not exceed the fees paid for the specific service
• We are not liable for indirect, consequential, or punitive damages
• We do not guarantee specific business outcomes from annotated data
• You acknowledge that AI/ML results depend on many factors beyond annotation quality

11. Warranties and Disclaimers

We provide services "as is" and disclaim all warranties except those that cannot be excluded by law. We warrant that:

• Services will be performed with professional skill and care
• We have the right to provide the agreed services
• We will comply with applicable data protection laws

We do not warrant that services will be error-free, uninterrupted, or meet all your requirements.
